I’ve been working at a jobber for 4months, as store manager. Yesturday the company owner comes in my store to talk to me. She tells me that she heard I’ve been spraying at night. She said that I am not allowed to work in this industry as long as I work for her. Now we only sell paint no paint services. If she hear again that I’m painting I’m fired. Now she hired me for my painting experience. Then she gives my store to a new guy and says I can work part time handeling big accounts, because everyone knows me. Talk about outright disrespect. What do you guys think about that?
June 29, 2013 at 12:14 am #43464Is that in your employment contract? As far as the new position, I’m sure they can move you anywhere they want. Don’t like it, leave. Unless she’s trying to force you out by intimidation.
Spraying at night in their facility, or at your house / shop?
At their place, I’d say they can dictate what you do or don’t. On your time, at your own place, I don’t think they really have much to stand on. If it really becomes an issue, a local HR attorney is probably your best bet.
Not condoning it but some employers do get a little precious about employees working second jobs because they feel that the employee might not perform at their best if tired from the long hours. This may be her concern.
Of course, if there is a contract that limits what you can do then you’re bound to that but I’d suspect that it could be quashed if taken to court. Trouble is that then you’d lose your job.
I’d be trying for a happy medium. Assure her that what you do after hours will not affect your performance, buy your products from the store wherever possible so they get something out of it too and make sure that your performance cannot be questioned.
June 30, 2013 at 6:21 pm #43483No contract. She said If I work for her company I can not work in any way related to this industry. It came up because I was asked to design a Susan G. Coleman cancer foundation Volkswagon. I mentioned it to a co-worker I even was thinking they might want to be involved. There are some underlying issues that she was just trying to push me out. I was the first english only speaking employee. I had to do all the books, inventory, billing payroll everything in spanish. I overcame it and they store did great. However they looked at me as if I wasn’t as good as them. As soon as they found a spanish and english speaker they started doing unfair things to get me to leave. I quit on thursday got hired on friday at a really nice shop worked on saturday. I must say the racisim that they had towards me made me very upset. I am the American I was born here how dare they? O well spilled milk makes you think though.
June 30, 2013 at 7:14 pm #43484Unfair labor practices. Report them even if you did quit. No contract and can’t work a second job? Give me a break. Red flags all over this situation. No second language and they hired you anyway? Those seeking jobs should interview their potential employers, their backgrounds and references. There’s bad shop owners and employees. If they don’t like it then you don’t want to do business with them.
June 30, 2013 at 10:46 pm #43486I wish I could go to IRS, labor folks and immigration but I can’t. I fear for my family’s safety. I have to just walk away. Here I am a law abiding citizen and I am intimidated by mega rich foreiners with seedy dealings.
July 1, 2013 at 12:41 am #43487Move, big country. There was a guy on T Chevelle from down south looking for help in a large resto shop. Couldn’t find anyone. If you like Satan’s weather that is. If you report someone they can keep it anonymous.
